Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Buzzle (“Buzzle,” “we,” “us,” or “our”). They govern your use of playbuzzle.com, our games, and everything else we offer (together, the “Service”).

By creating an account, joining a game, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you accept these Terms for a school, a district, or another organization, you confirm that you have the authority to bind that organization, and “you” means that organization.

• Account holders. You must be at least 18 years old, or the age of majority where you live, to create a Buzzle account.
• Students. Students join a game with a game code and a nickname. They do not need an account. A student under 18 may use the Service only under the direction of a teacher, school, or parent who has agreed to these Terms on their behalf.
• Schools. A school or district that uses Buzzle with students is responsible for obtaining any consent that the law requires, including consent under COPPA and FERPA in the United States.

Keep your password secret, and keep your account information accurate. You are responsible for everything that happens under your account. Tell us right away if you believe someone else has used it.

You must not share an account with another teacher, sell it, or transfer it, unless we agree in writing.

When you use the Service, you must not:

• Break the law, infringe anyone’s rights, or help anyone else do either.
• Upload or create content that is hateful, harassing, sexual, violent, or otherwise inappropriate for a classroom.
• Enter a student’s real name, contact details, or other personal information as a nickname.
• Try to break, overload, probe, or gain unauthorized access to the Service or to anyone else’s account or data.
• Copy, scrape, resell, or redistribute the Service or its content, except as these Terms allow.
• Reverse engineer the Service, or use it to build a competing product.
• Use automated tools to create accounts, join games, or generate content at scale.

A teacher who hosts a game is responsible for what happens in that game, including the nicknames and answers their students submit. Hosts have tools to rename or remove a player, and we expect them to use those tools.

“Your Content” means the topics you enter, the question sets you create or edit, and anything else you submit to the Service. You keep ownership of Your Content.

You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, display, and adapt Your Content, but only so far as we need it to operate, secure, and improve the Service. This license ends when you delete Your Content, except for copies we keep in routine backups or must keep by law.

You confirm that you have the rights to Your Content, and that it does not infringe anyone else’s rights.

Buzzle uses artificial intelligence to generate question sets and other classroom content. AI output can be wrong, incomplete, or unsuitable for your class, and two people who enter the same topic may get different results.

Review every question set before you use it with students. You decide what your class sees. We do not warrant that generated content is accurate, appropriate, or fit for any curriculum or standard.

The Service, including our software, artwork, characters, game designs, and the Buzzle name and logo, belongs to us or to our licensors. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for teaching and learning, under these Terms. We keep every right we do not grant you here.

• Plans. Some features need a paid plan. The current plans and prices are on our pricing page.
• Payment. A third-party payment provider processes payments. You authorize us to charge your payment method for the plan you choose, plus any tax.
• Renewal. A paid plan renews automatically at the end of each billing period, at the price then in effect, until you cancel.
• Cancellation. You can cancel at any time. Your plan stays active until the end of the period you already paid for.
• Refunds. Payments are non-refundable, except where the law requires a refund or where we say otherwise in writing.
• Price changes. We may change prices. We will give you notice before a change applies to your renewal.

The Service relies on third parties for hosting, payments, AI models, and sign-in. If you sign in with Google or another provider, that provider’s own terms apply to your use of it. We are not responsible for third-party services, and we do not control them.

Our Privacy Policy explains what information we collect and how we use it. It is part of these Terms.

You can stop using the Service at any time, and you can ask us to delete your account.

We can suspend or end your access if you break these Terms, if your use puts students or other users at risk, if we must do so by law, or if we stop offering the Service. Where it is reasonable to do so, we will give you notice first.

The sections on Your Content, Our Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law survive the end of this agreement.

The Service is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that generated content will be accurate or suitable for your class.

To the fullest extent the law allows, Buzzle is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or instructional time.

Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the event that gave rise to the claim, or (b) one hundred United States dollars.

Some jurisdictions do not allow these limits. Where that is the case, the limits above apply only so far as the law allows.

You agree to defend, indemnify, and hold Buzzle harmless from any claim, loss, or cost, including reasonable legal fees, that arises out of Your Content, your use of the Service, or your breach of these Terms. This does not apply where the law does not permit it, including for public schools and other government bodies that cannot indemnify by law.

We improve Buzzle continuously, so features can change, and some can go away. We may update these Terms as well. When we do, we will revise the “Last updated” date above. If we make material changes, we will give you a more prominent notice. If you keep using the Service after a change takes effect, you accept the new Terms.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You and Buzzle agree to bring any dispute in the state or federal courts located in California, and you consent to the jurisdiction of those courts.

If a public school, district, or other government body cannot agree to this section under the law that applies to it, that law governs instead.

If any part of these Terms is held unenforceable, the rest stays in force.
